WASHINGTON DC – Following President Biden\u2019s visit to the\u00a0southwest border and his meeting with Mexican President\u00a0L\u00f3pez Obrador, Senators Edward J. Markey (D-Mass.), Elizabeth Warren (D-Mass.) and Cory Booker (D-N.J.) sent a letter to Attorney General Merrick Garland, Secretary of Homeland Security Alejandro Mayorkas, and Acting U.S. Customs and Border Protection (CBP) Administrator Troy Miller expressing serious concerns over the rise of paramilitary vigilante groups patrolling the U.S.-Mexico border and unlawfully intimidating, harassing, and detaining immigrants,\u00a0sometimes in collaboration with, or with approval from, local, state, and federal law enforcement agencies.\u00a0<\/p>\n\n\n\n

As the Biden\u00a0administration announces new border enforcement policies, the lawmakers urge\u00a0it\u00a0to crack down on vigilante groups that undermine the rule of law, as well as the rights and safety of migrants.\u00a0<\/p>\n\n\n\n

\u201cFor years, unlawful paramilitary organizations have engaged in unofficial border missions \u2014 reminiscent of Ku Klux Klan border patrols\u00a0 \u2014 intended to illegally detain and harass immigrants. These activities undermine legitimate government authority and threaten public safety,\u201d\u00a0wrote Senators Markey, Warren, and Booker. \u201cRecently, many paramilitary groups have stepped up their efforts, creating an escalating crisis that must be a priority for both the U.S. Department of Homeland Security and the U.S. Department of Justice.\u201d<\/p>\n\n\n\n

The senators highlighted their concerns over the actions of paramilitary group Veterans on Patrol (VOP),\u00a0writing: \u201cSince 2021, VOPhas been intercepting unaccompanied minors near the border in Arizona, surveilling U.S.-based sponsors, and in some cases, confronting, or helping others confront, the sponsors at their homes. VOP has also disguised its desert campsites as water stations \u2014 meant to mimic those placed by faith-based organizations such as Humane Borders \u2014 in order to lure migrants; VOP then turns them over to CBP.\u201d<\/sup><\/p>\n\n\n\n

The senators also directed the Administration\u2019s attention to alarming reports of collaboration between law enforcement officials and the group Patriots for America (PFA), writing:\u00a0\u201cAccording to the American Civil Liberties Union in Texas, PFA is \u2018directly collaborating with the Kinney County Sheriff\u2019s Office\u2019 and \u2018on at least one occasion they seem to have collaborated with the Texas National Guard as well.\u2019 Alarmingly, there is also evidence of open collaboration with federal agents. In May 2021, a video uploaded to Facebook depicted a Border Patrol agent meeting with VOP members and praising their activities before collecting drone footage from the group.\u201d<\/p>\n\n\n\n

The letter concluded,\u00a0\u201cAbsent federal action cracking down on their unauthorized behavior, vigilante groups will continue to operate and weaken the government\u2019s ability to maintain migrant safety, protect human rights, and defend the rule of law at the border.\u201d<\/p>\n\n\n\n

Senators Markey, Warren and Booker requested that DOJ, DHS, and CBP respond to the following questions by January 30, 2023:<\/p>\n\n\n\n

  1. Are DHS, CBP, or DOJ aware of any ongoing activity by paramilitary groups aimed at migrants crossing the U.S.-Mexico border, including but not limited to, activity by VOP and PFA? What actions, if any, have been taken in response?<\/li>\n\n\n\n
  2. What data or internal reporting, if any, have DHS, CBP, or DOJ generated on paramilitary groups operating at the border? If no data or internal reporting has been generated, why not?<\/li>\n\n\n\n
  3. Are DHS, CBP, or DOJ aware of any incidents in which paramilitary groups have obtained sponsor information from unaccompanied minors at the border or confronted sponsors at their homes? If so, what has been done in response?<\/li>\n\n\n\n
  4. Does CBP maintain any formal or informal policies regarding engagements with or interactions between CBP officials and paramilitary groups along the U.S.-Mexico border?<\/li>\n\n\n\n
  5. What disciplinary action, if any, has been taken against CBP agents collaborating with paramilitary groups to harass and intimidate migrants, including any action against the agent appearing in the May 2021 Facebook video referenced above?<\/li>\n\n\n\n
  6. Will DHS direct CBP to issue formal guidelines prohibiting agents from actively supporting unauthorized paramilitary organizations and other extremist groups? If not, why?<\/li>\n\n\n\n
  7. Is judicial accountability for violence and other unlawful activity perpetrated by unauthorized paramilitary groups or their individual members against migrants a DOJ priority?<\/li>\n\n\n\n
  8. What direction and resources, if any, has DOJ given to federal law enforcement to investigate paramilitary groups\u2019 or their individual members\u2019 conduct towards to migrants crossing the southern border?<\/li>\n\n\n\n
  9. Will DOJ ensure that any criminal conduct by paramilitary organizations and their members against migrants at the southern border is prosecuted?<\/li>\n<\/ol>\n\n\n\n
