{"id":48862,"date":"2021-09-07T12:42:00","date_gmt":"2021-09-07T16:42:00","guid":{"rendered":"https:\/\/framinghamsource.com\/?p=48862"},"modified":"2021-09-07T12:44:00","modified_gmt":"2021-09-07T16:44:00","slug":"mass-ag-secures-2-25-million-settlement-from-national-debt-collection-company","status":"publish","type":"post","link":"https:\/\/framinghamsource.com\/index.php\/2021\/09\/07\/mass-ag-secures-2-25-million-settlement-from-national-debt-collection-company\/","title":{"rendered":"Mass AG Secures $2.25 Million Settlement From National Debt Collection Company"},"content":{"rendered":"\n<p><em>In full transparency, the following press release was submitted to SOURCE media by the Massachusetts Attorney General&#8217;s office<\/em>.<\/p>\n\n\n\n<p>***<\/p>\n\n\n\n<p><strong>[broadstreet zone=&#8221;53820&#8243;]<\/strong><\/p>\n\n\n\n<p>BOSTON &#8211; A national debt collection company has agreed to pay $2.25 million and change its business practices to resolve allegations that it used unfair and deceptive debt collection practices against consumers, including student borrowers, Attorney General Maura Healey announced today, September 7.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/p>\n\n\n\n<p>The\u00a0<a rel=\"noreferrer noopener\" href=\"https:\/\/www.mass.gov\/doc\/transworld-systems-aod\" target=\"_blank\">assurance of discontinuance<\/a>, filed today in Suffolk County Superior Court with Transworld Systems, Inc., resolves allegations that the company violated the\u00a0<a rel=\"noreferrer noopener\" href=\"https:\/\/www.mass.gov\/service-details\/fair-debt-collection\" target=\"_blank\">AG\u2019s Debt Collection Regulations<\/a>\u00a0by making high volume calls to consumers, regularly attempting to collect on time-barred debts, and using false and misleading affidavits in an effort to collect private student loan debt on behalf of the National Collegiate Student Loan Trusts (NCT).<\/p>\n\n\n\n<p> \u201cThis company routinely violated state laws and regulations by harassing and misleading vulnerable, low-income consumers and student borrowers,\u201d said\u00a0AG Healey.\u00a0\u201cOne of my office\u2019s top priorities is to protect the economic security of Massachusetts residents, and we will take action against companies that engage in illegal debt collection practices.\u201d<\/p>\n\n\n\n<p><strong>[broadstreet zone=&#8221;59945&#8243;]<\/strong><\/p>\n\n\n\n<p><strong>[broadstreet zone=&#8221;59983&#8243;]<\/strong><\/p>\n\n\n\n<p>Transworld is one of the nation\u2019s largest debt collectors and serves as the primary debt collector for private student loan debt held by NCT. <\/p>\n\n\n\n<p>The AG\u2019s investigation found that Transworld excessively contacted consumers both at their homes and places of employment, in violation of the AG\u2019s\u00a0Debt Collection Regulations which prohibit more than two calls to a consumer\u2019s home in a seven-day period. <\/p>\n\n\n\n<p>Debt collectors also cannot call a consumer at work or other non-residential number more than two times a month.<\/p>\n\n\n\n<p>Transworld frequently attempted to collect debts from consumers that were so old that the debt was \u201ctime-barred,\u201d meaning that these debts were no longer legally enforceable through a lawsuit. <\/p>\n\n\n\n<p><strong>[broadstreet zone=&#8221;59946&#8243;]<\/strong><\/p>\n\n\n\n<p>Massachusetts debt collection regulations prohibit the collection of a time-barred debt unless the consumer is provided notice that debt is time-barred and that a consumer cannot be required to pay the debt through a lawsuit, which Transworld failed to do.\u00a0<\/p>\n\n\n\n<p>Transworld created false and misleading affidavits to use as evidence against consumers in debt collection lawsuits related to NCT student loan debts. Transworld\u2019s employees who signed the affidavits did not have personal knowledge of the facts in the affidavit or sufficient evidence that NCT owned the loans, despite attesting to that as fact.&nbsp;<\/p>\n\n\n\n<p>\u00a0 In addition to the $2.25 million payment, Transworld has agreed to significant changes in its business practices, including preventing excessive calls, call attempts, or voicemails to consumers and requiring all law firms collecting on its behalf to take the same preventative measures.
