Assistant Speaker Clark is a Democrat.<br><br>***<\/em><\/p>\n\n\n\n<p><strong>[broadstreet zone=&#8221;53130&#8243;]<\/strong><\/p>\n\n\n\n<p>WASHINGTON DC  &#8211; Assistant Speaker Katherine Clark (MA-5) voted today, May 14, to pass the bipartisan Pregnant Workers Fairness Act to establish pregnant workers\u2019 right to reasonable workplace accommodations. <\/p>\n\n\n\n<p>Introduced by Representative Jerrold Nadler (NY-10), the Pregnant Workers Fairness Act passed by a vote of 315-101.\u00a0<\/p>\n\n\n\n<p>\u201cNo parent should ever be forced to choose between a healthy pregnancy or a paycheck,\u201d\u00a0said Assistant Speaker Clark.\u00a0\u201cRight now, women are at a 33 year low in workforce participation because our economic infrastructure too often fails to meet the needs of working women. With this bill, workers would not be denied employment opportunities, reasonable accommodations, or be forced to leave their jobs without pay just because they are pregnant. This legislation is critical to ensure that employers are held accountable and that women have the same opportunities for success.\u201d\u00a0<\/p>\n\n\n\n<p>The Pregnant Workers Fairness Act has\u00a0<a href=\"https:\/\/www.abetterbalance.org\/resources\/2020-letter-of-support-for-the-pregnant-workers-fairness-act-from-over-100-supporting-organizations\/\" target=\"_blank\" rel=\"noreferrer noopener\">broad support from more than 200<\/a>\u00a0worker advocates, civil rights groups, and business groups, including the\u00a0<a href=\"https:\/\/www.uschamber.com\/letters-congress\/us-chamber-key-vote-letter-the-pregnant-workers-fairness-act\" target=\"_blank\" rel=\"noreferrer noopener\">U.S. Chamber of Commerce<\/a>. <\/p>\n\n\n\n<p><strong>[broadstreet zone=&#8221;59982&#8243;]<\/strong><\/p>\n\n\n\n<p>In a\u00a0<a href=\"https:\/\/www.aclu.org\/sites\/default\/files\/field_document\/pwfa_survey_memo_2-20-20_1_1_2.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">recent survey of voters<\/a>\u00a0across the country, 89 percent said they support the proposal, including 81 percent of Republicans, 86 percent of Independents, and 96 percent of Democrats.<\/p>\n\n\n\n<p>Under the Pregnant Workers Fairness Act:\u00a0Private sector employers with more than 15 employees as well as public sector employers must make reasonable accommodations for pregnant workers (employees and job applicants with known limitations related to pregnancy, childbirth, or related medical conditions). <\/p>\n\n\n\n<p>Like the Americans with Disabilities Act, employers are not required to make an accommodation if it imposes an undue hardship on an employer\u2019s business.<\/p>\n\n\n\n<p><strong>[broadstreet zone=&#8221;58610&#8243;]<\/strong><\/p>\n\n\n\n<p>Pregnant workers cannot be denied employment opportunities, retaliated against for requesting a reasonable accommodation, or forced to take paid or unpaid leave if another reasonable accommodation is available.<\/p>\n\n\n\n<p>Workers denied a reasonable accommodation under the Pregnant Workers Fairness Act will have the same rights and remedies as those established under Title VII of the Civil Rights Act of 1964. <\/p>\n\n\n\n<p>These include lost pay, compensatory damages, and reasonable attorneys\u2019 fees.
