{"id":35398,"date":"2021-04-26T10:50:00","date_gmt":"2021-04-26T14:50:00","guid":{"rendered":"https:\/\/framinghamsource.com\/?p=35398"},"modified":"2021-04-26T10:54:30","modified_gmt":"2021-04-26T14:54:30","slug":"baker-polito-administration-files-legislation-to-improve-road-safety","status":"publish","type":"post","link":"https:\/\/framinghamsource.com\/index.php\/2021\/04\/26\/baker-polito-administration-files-legislation-to-improve-road-safety\/","title":{"rendered":"Baker-Polito Administration Files Legislation to Improve Road Safety"},"content":{"rendered":"\n<p><strong>The following is a press release from the Governor&#8217;s office submitted to SOURCE media<\/strong><\/p>\n\n\n\n<p>***<\/p>\n\n\n\n<p><strong>[broadstreet zone=&#8221;59945&#8243;]<\/strong><\/p>\n\n\n\n<p>BOSTON\u00a0\u2013 The Baker-Polito Administration today, April 26, filed legislation to improve road safety, entitled, \u201cAn Act Relative to Improving Safety on the Roads of the Commonwealth.\u201d <\/p>\n\n\n\n<p>The legislation includes provisions previously filed by the Administration in 2019 and several new proposals, including increasing penalties for individuals who cause personal injury while driving on a non-administratively suspended license.<\/p>\n\n\n\n<p>\u201cThese proposals will make Massachusetts roadways and streets\u00a0safer for all travelers and will help reduce roadway fatalities across the state,\u201d\u00a0said Governor Charlie Baker.\u00a0\u201cThis legislative package builds upon laws enacted in 2019 to prevent and enforce distracted driving, and we look forward to working with our partners in the Legislature to take additional steps to improve road safety.\u201d<\/p>\n\n\n\n<p><strong>[broadstreet zone=&#8221;59947&#8243;]<\/strong><\/p>\n\n\n\n<p>\u201cThis legislation\u00a0will make a difference for all travelers in the Commonwealth including\u00a0pedestrians, bicyclists, and drivers,&#8221;\u00a0said Lt. Governor Karyn Polito.\u00a0&#8220;We are grateful for the\u00a0input from municipal leaders,\u00a0advocacy groups and non-profit organizations,\u00a0which allow us to take steps that will save lives and prevent injuries in communities throughout the Commonwealth.\u201d<\/p>\n\n\n\n<p>\u201cThe new laws are first and foremost in keeping with our goal to reduce the number of deaths on our roads,\u201d\u00a0said Acting Secretary of Transportation Jamey Tesler.\u00a0\u201cCrashes due to distracted driving, speeding, and other unsafe driving behaviors, continue to occur on Massachusetts roadways despite reduced driving levels during the pandemic, and these proposals will help refocus and change current driving habits and behaviors to ensure that individuals remain safe.\u201d \u00a0<\/p>\n\n\n\n<p><strong>[broadstreet zone=&#8221;59946&#8243;]<\/strong><\/p>\n\n\n\n<p>\u201cPreventing roadway injuries and fatalities is a priority for all of us at EOPSS,\u201d\u00a0said Massachusetts Public Safety Secretary Thomas Turco.\u00a0\u201cThese common-sense proposals are important to make sure that drivers, passengers, and vulnerable road users like pedestrians and bicyclists can all get home safely.\u201d<\/p>\n\n\n\n<p>An Act Relative to Improving Safety on the Roads of the Commonwealth,&nbsp;includes proposals on the following new and previously filed topics:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Primary Seatbelt:<\/strong>&nbsp;allows law enforcement to stop motorists for not wearing a seatbelt.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Haley\u2019s Law:<\/strong>&nbsp;increases penalties for individuals who cause personal injury while driving on a non-administratively suspended license. New provisions would create three levels of new \u201caggravating factors\u201d to driving while suspended: 1) Driving negligently\/recklessly: fine up to $1,000 and&nbsp;up to&nbsp;5 years&nbsp;in prison; 2) Causing \u201cserious bodily injury:\u201d fine up $3,000 and house of correction up to 2.5 years; and 3) Causing death: fine up to $5,000 and mandatory 2 years to a maximum of 10 years in prison. Current statute simply penalizes for driving while suspended.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Traffic Camera Enforcement Local Option:<\/strong>\u00a0allows localities to place red light cameras at intersections (and the Department of Conservation and Recreation (DCR)\/MassDOT-owned roads that serve as local roads with DCR\/MassDOT permission). Cameras would be restricted to collecting photographs only upon a violation and only of the vehicle license plates. Violations would include running a red light and making an illegal turn on a red light.<\/li><\/ul>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"455\" height=\"655\" src=\"https:\/\/framinghamsource.com\/wp-content\/uploads\/2020\/03\/virus.food_.source.house_.ad_.2020.jpg\" alt=\"source\" class=\"wp-image-3730\" srcset=\"https:\/\/framinghamsource.com\/wp-content\/uploads\/2020\/03\/virus.food_.source.house_.ad_.2020.jpg 455w, https:\/\/framinghamsource.com\/wp-content\/uploads\/2020\/03\/virus.food_.source.house_.ad_.2020-208x300.jpg 208w\" sizes=\"auto, (max-width: 455px) 100vw, 455px\" \/><\/figure>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Bicycle Safe Passing:<\/strong>&nbsp;requires a driver to maintain a 3 foot \u201csafe passing distance\u201d and to travel at a speed that is reasonable and proper when passing a bicyclist or pedestrian when there isn\u2019t any physical separation (such as a protected bike lane or curb). Thirty-six other states have \u201csafe distance\u201d requirements.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Commercial Driver\u2019s License (CDL) Changes:<\/strong>&nbsp;a refile of previously filed changes to the state\u2019s CDL laws,&nbsp;which include updates to conform to federal law.&nbsp;<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Crash Data Reporting:<\/strong>\u00a0proposes adding to reporting requirements crash information involving \u201ca vulnerable user,\u201d a term which would include pedestrians, bicyclists, public works or public safety personnel working in the right of way, individuals on farm tractors, and users of other mobility devices such as scooters and in-line skates. Current statute requires drivers to report any crashes resulting in serious bodily injury, death, or property damage in excess of $1000. This reporting on crashes involving vulnerable users will assist municipalities and state transportation entities to identify problem areas or emerging trends.<\/li><\/ul>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"477\" height=\"650\" src=\"https:\/\/framinghamsource.com\/wp-content\/uploads\/2020\/07\/car.wash_.source.house_.ad_.july_.2020.jpg\" alt=\"\" class=\"wp-image-13348\" srcset=\"https:\/\/framinghamsource.com\/wp-content\/uploads\/2020\/07\/car.wash_.source.house_.ad_.july_.2020.jpg 477w, https:\/\/framinghamsource.com\/wp-content\/uploads\/2020\/07\/car.wash_.source.house_.ad_.july_.2020-220x300.jpg 220w\" sizes=\"auto, (max-width: 477px) 100vw, 477px\" \/><\/figure>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Side Guards and Additional Mirrors:<\/strong>&nbsp;requires all Commonwealth-owned and operated vehicles over 10,000 pounds to have side guards, convex mirrors and cross-over mirrors.&nbsp;Additionally, all Commonwealth and municipal contractors would be required to have these devices by January 1, 2024. Side guards protect bicyclists and pedestrians from being swept under large vehicles, which can happen, for example, when vehicles are making tight turns at intersections.
