{"id":14025,"date":"2020-07-13T13:39:00","date_gmt":"2020-07-13T17:39:00","guid":{"rendered":"https:\/\/framinghamsource.com\/?p=14025"},"modified":"2020-07-13T13:39:35","modified_gmt":"2020-07-13T17:39:35","slug":"universal-health-services-to-pay-15-million-to-massachusetts-to-resolve-whistleblower-false-claims-cases","status":"publish","type":"post","link":"https:\/\/framinghamsource.com\/index.php\/2020\/07\/13\/universal-health-services-to-pay-15-million-to-massachusetts-to-resolve-whistleblower-false-claims-cases\/","title":{"rendered":"Universal Health Services To Pay $15 Million To Massachusetts To Resolve Whistleblower False Claims Cases"},"content":{"rendered":"\n<p><em>The following is a press release from the Massachusetts Attorney General&#8217;s office to SOURCE media.<\/em><\/p>\n\n\n\n<p>***<\/p>\n\n\n\n<p><strong>[broadstreet zone=&#8221;80100&#8243;]<\/strong><\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" src=\"https:\/\/framinghamsource.com\/wp-content\/uploads\/2020\/07\/source.13000.house_.ad_.2020.png\" alt=\"\" class=\"wp-image-13722\"\/><\/figure>\n\n\n\n<p>BOSTON \u2013\u00a0Massachusetts Attorney General Maura Healey announced today, July 13, that Universal Health Services (UHS) will\u00a0pay over $15 million to resolve two separate sets of allegations that the company improperly billed the state\u2019s Medicaid Program (MassHealth).<\/p>\n\n\n\n<p>Under the terms of the first settlement agreement, UHS and its affiliates, UHS of Delaware, Inc, and HRI Clinics, Inc. d\/b\/a Arbour Counseling Services, will pay $10 million to resolve allegations in two lawsuits regarding false claims to MassHealth for outpatient mental health services between 2009 and 2017 at outpatient mental health centers throughout Massachusetts, including in Allston, Fall River, Franklin, Haverhill, Lawrence, Lowell, Malden, Norwell, Woburn, and Worcester.<\/p>\n\n\n\n<p><strong>[broadstreet zone=&#8221;59983&#8243;]<\/strong><\/p>\n\n\n\n<p>The AG\u2019s Office, along with the whistleblowers in this case, specifically alleged that the defendants caused the submission of claims for services provided by unlicensed and non-independently licensed staff who were not properly supervised; for medications prescribed by psychiatric nurses who were also not properly supervised; for services performed by unlicensed, unsupervised, and unqualified psychologists; and for employing clinicians with inadequate educational credentials.<\/p>\n\n\n\n<p>\u201cThis company routinely allowed unqualified and unsupervised mental health professionals to provide care to patients and improperly billed MassHealth for it,\u201d said Healey. \u201cThis behavior put patients at risk and wasted critically needed health care dollars. With this settlement, millions of dollars will now be returned to our state.\u201d<\/p>\n\n\n\n<p>The whistleblowers in this case, Julio Escobar and Carmen Correa, originally filed a\u00a0<em>qui tam\u00a0<\/em>suit in 2011 in the U.S. District Court of Massachusetts captioned\u00a0<em>United States et al. ex rel. Escobar et al. v. Universal Health Services, Inc. et al.,<\/em>\u00a0(<em>Escobar<\/em>).\u00a0<\/p>\n\n\n\n<p><strong>[broadstreet zone=&#8221;59984&#8243;]<\/strong><\/p>\n\n\n\n<p>This case went up to the U.S. Supreme Court, which, in 2016, decided that the \u201cimplied certification theory\u201d of liability in False Claims Act cases was viable, meaning that a provider of services can be responsible for submitting false claims to government payors if the claims make specific representations about the services provided or if the defendant\u2019s failure to disclose noncompliance with certain regulations makes the filing of claims \u201cmisleading half-truths.\u201d\u00a0<em>Escobar<\/em>\u00a0remains the most recent, influential decision from the Supreme Court on False Claims Act cases.<\/p>\n\n\n\n<p>After the Supreme Court remanded&nbsp;<em>Escobar<\/em>&nbsp;to the federal court in Massachusetts for further litigation, the whistleblowers brought a separate suit in September 2017 \u2013&nbsp;<em>United States et al. ex rel. Correa et al. v. Universal Health Services, Inc. et al.<\/em>,<em>&nbsp;(Correa) \u2013&nbsp;<\/em>which contained similar allegations to&nbsp;<em>Escobar<\/em>. The settlement agreement with the AG\u2019s Office resolves the allegations against UHS in both&nbsp;<em>Escobar<\/em>&nbsp;and&nbsp;<em>Correa<\/em>.<\/p>\n\n\n\n<p>As part of the resolution in\u00a0<em>Escobar<\/em>\u00a0and\u00a0<em>Correa<\/em>, Arbour Counseling Services will institute a multiyear compliance program, overseen by an independent compliance monitor, at all of its Massachusetts outpatient clinics.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"477\" height=\"650\" src=\"https:\/\/framinghamsource.com\/wp-content\/uploads\/2020\/07\/car.wash_.source.house_.ad_.july_.2020.jpg\" alt=\"\" class=\"wp-image-13348\" srcset=\"https:\/\/framinghamsource.com\/wp-content\/uploads\/2020\/07\/car.wash_.source.house_.ad_.july_.2020.jpg 477w, https:\/\/framinghamsource.com\/wp-content\/uploads\/2020\/07\/car.wash_.source.house_.ad_.july_.2020-220x300.jpg 220w\" sizes=\"auto, (max-width: 477px) 100vw, 477px\" \/><\/figure>\n\n\n\n<p>In the second settlement agreement, Massachusetts joined other states and the federal government to settle allegations of fraud against UHS arising from UHS\u2019s inpatient and residential psychiatric and behavioral health facilities. <\/p>\n\n\n\n<p>The total value of the national settlement is $117 million, and Massachusetts will receive nearly $5.5 million as a result. The settlement resolves allegations that, from 2007 through 2018, UHS submitted\u00a0claims for payment to government healthcare programs for services provided to Medicaid beneficiaries at residential and inpatient treatment facilities who were not eligible for inpatient or residential treatment. <\/p>\n\n\n\n<p>The settlement further resolves allegations that UHS failed to properly discharge beneficiaries when they no longer needed inpatient or residential treatment leading to improper and excessive lengths of stay, failed to provide adequate staffing, training and\/or supervision of staff, billed for services not rendered, and engaged in the improper use of physical and chemical restraints.\u00a0<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"455\" height=\"655\" src=\"https:\/\/framinghamsource.com\/wp-content\/uploads\/2020\/03\/virus.food_.source.house_.ad_.2020.jpg\" alt=\"\" class=\"wp-image-3730\" srcset=\"https:\/\/framinghamsource.com\/wp-content\/uploads\/2020\/03\/virus.food_.source.house_.ad_.2020.jpg 455w, https:\/\/framinghamsource.com\/wp-content\/uploads\/2020\/03\/virus.food_.source.house_.ad_.2020-208x300.jpg 208w\" sizes=\"auto, (max-width: 455px) 100vw, 455px\" \/><\/figure>\n\n\n\n<p>This second UHS settlement results from 18 whistleblower lawsuits originally filed in federal courts throughout the country. A National Association of Medicaid Fraud Control Units (NAMFCU) team investigated the allegations in conjunction with the U.S. Department of Justice.<\/p>\n\n\n\n<p>In the AG\u2019s Office, the&nbsp;<em>Escobar<\/em>&nbsp;and&nbsp;<em>Correa<\/em>&nbsp;matters were handled by Assistant Attorney General Philip Schreiber, Assistant Attorney General Robyn Dollar, Assistant Attorney General Evelyn Tang, and Investigators William Welsh, April Waterhouse, and Denise Long of the AG\u2019s Medicaid Fraud Division, with assistance from the U.S. Health and Human Services, Office of Inspector General and the U.S. Attorney\u2019s Office in Boston. Significant assistance was provided by the whistleblowers\u2019 law firm, Greene, LLP, and by MassHealth.&nbsp;<\/p>\n\n\n\n<p>The second UHS matter was handled by Managing Attorney Jennifer Goldstein, Assistant Attorney General Evelyn Tang, and Senior Health Care Fraud Investigator Christine Barker, and Investigators Denise Long and William Welsh, of the AG\u2019s Medicaid Fraud Division, with assistance from MassHealth and the Office of the Inspector General. Jennifer Goldstein worked with the National Association of Medicaid Fraud Control Units (NAMFCU) team to investigate and settle the second UHS matter.<\/p>\n\n\n\n<p>The AG\u2019s Medicaid Fraud Division receives 75 percent of its funding from the U.S. Department of Health and Human Services under a grant award.
