zone=&#8221;80100&#8243;]<\/strong><\/p>\n\n\n\n<p>BOSTON\u00a0\u2013\u00a0Massachusetts Attorney General Maura Healey today, July 1, sent a cease and desist letter demanding that a national firework retailer with locations in New Hampshire immediately stop mailing advertisements to Massachusetts residents in violation of the state\u2019s consumer protection law.\u00a0<\/p>\n\n\n\n<p>The AG\u2019s\u00a0<a href=\"https:\/\/www.mass.gov\/doc\/phantom-fireworks-cease-and-desist\" target=\"_blank\" rel=\"noreferrer noopener\">letter<\/a>\u00a0alleges that Phantom Fireworks has been mailing advertisements and discount coupons to residences across Massachusetts highlighting the proximity of its New Hampshire retail stores to Boston and Springfield and encouraging residents to celebrate July Fourth \u201cin backyards across America.\u201d <\/p>\n\n\n\n<p>The AG\u2019s Office alleges these advertisements are intentional offers to sell Massachusetts residents fireworks for use within Massachusetts, which is illegal under state law.<\/p>\n\n\n\n<p><strong>[broadstreet zone=&#8221;53820&#8243;]<\/strong><\/p>\n\n\n\n<p>\u201cPhantom Fireworks knows its products are illegal in Massachusetts, yet we are hearing that residents are getting their advertisements in the mail,\u201d said Healey. \u201cWe sent a cease and desist to stop this intentional marketing scheme and prevent more of these unsafe products from being brought into our neighborhoods.\u201d<\/p>\n\n\n\n<p>Massachusetts law M.G.L c. 148, \u00a7 39 prohibits the sale or offering for sale of fireworks, and prohibits the possession, use, or explosion of fireworks in the state. <\/p>\n\n\n\n<p>Under Chapter 93A, the state\u2019s consumer protection law, businesses cannot advertise or sell products that are unsafe and illegal, such as fireworks.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"519\" height=\"608\" src=\"https:\/\/framinghamsource.com\/wp-content\/uploads\/2020\/02\/rune.up_.business.source.house_.ad_.2018.png\" alt=\"\" class=\"wp-image-445\" srcset=\"https:\/\/framinghamsource.com\/wp-content\/uploads\/2020\/02\/rune.up_.business.source.house_.ad_.2018.png 519w, https:\/\/framinghamsource.com\/wp-content\/uploads\/2020\/02\/rune.up_.business.source.house_.ad_.2018-256x300.png 256w\" sizes=\"auto, (max-width: 519px) 100vw, 519px\" \/><\/figure>\n\n\n\n<p> <\/p>\n\n\n\n<p>The AG\u2019s Office has received several complaints from consumers who say they received advertisements from Phantom Fireworks. <\/p>\n\n\n\n<p>Their advertisement practices are also in violation of the state\u2019s consumer protection law by directly marketing a product that is illegal to possess or use to Massachusetts residents and proposing that residents engage in conduct that the state has deemed to be unsafe and illegal.<\/p>\n\n\n\n<p>The AG\u2019s Office encourages consumers who receive advertisements of this nature to\u00a0<a href=\"https:\/\/www.mass.gov\/how-to\/file-a-health-care-complaint\" target=\"_blank\" rel=\"noreferrer noopener\">file a complaint online.<\/a>\u00a0\u00a0<\/p>\n\n\n\n<p><strong>[broadstreet
